Data Center Energy LLC is a company organized under the laws of the United States and does not maintain a legal entity or establishment in Brazil.

Data Protection Officer (DPO)

Data Center Energy LLC has appointed a role-based Data Protection Officer in accordance with Article 41 of the LGPD.

This Privacy Notice applies to individuals located in Brazil whose personal data is processed by Data Center Energy LLC, including:

This Notice applies solely to personal data processed in connection with Data Center Energy's business activities.

We process personal data for the following purposes and based on the corresponding legal grounds under the LGPD:

• Responding to inquiries and communications
  Personal data is processed to respond to requests and inquiries submitted through our website.
  Legal basis: performance of contract or preliminary contractual procedures (Art. 7(V)) and legitimate interest (Art. 7(IX)).

• Providing and offering services
  Personal data is processed to provide brokerage, marketplace, and related services.

• Marketing and newsletter communications
  Personal data is processed to send newsletters or informational communications when you opt in.

  Personal data is processed to support business development and customer relationship management activities.
  Legal basis: legitimate interest (Art. 7(IX)), balanced against your fundamental rights and freedoms.

We collect and process only the personal data necessary to achieve the purposes described above, in accordance with the principles of necessity and data minimization.

Where processing is based on your consent, you may choose whether or not to provide consent and may withdraw it at any time without affecting the lawfulness of processing carried out prior to withdrawal.

Personal data is disclosed only for internal business purposes and is accessible solely to authorized personnel.

Data Center Energy LLC processes personal data primarily in the United States. As a result, personal data collected from individuals in Brazil may be transferred to and processed outside Brazil. Such transfers are conducted in accordance with applicable data protection laws and appropriate safeguards.

We do not sell personal data.

We implement appropriate technical and organizational measures to protect personal data against unauthorized access, loss, misuse, alteration, or disclosure, including:

We maintain records of personal data processing activities as required by the LGPD and take reasonable steps to ensure the security and confidentiality of personal data.

Data Center Energy LLC is part of a connected ecosystem of five separately operated legal entities, each with its own brand and privacy notice: Datacenters.com, DataCenterInvest.com, DataCenterRealEstate.com, and DataCenters.ai. Each entity operates independently but shares common ownership and a unified data infrastructure.

Cross-entity data access is limited to authorized personnel and is restricted to the business purposes described in this Notice. We do not sell personal data across entities or to third parties.

Data Center Energy uses artificial intelligence technologies to support certain business functions, including lead qualification, inquiry routing, and service recommendations. These AI systems may process personal data — such as contact details, business information, and website interaction data — to perform these functions.

AI-assisted processing at Data Center Energy is conducted through DataCenters.ai, the intelligence layer of the Datacenters.com ecosystem. DataCenters.ai may analyze data submitted through any of our affiliated brands to generate recommendations or route inquiries to the appropriate service or team.

We do not use AI to make fully automated decisions that produce legal or similarly significant effects on individuals without human review. Where AI-assisted outputs inform business decisions, a human remains involved in the final determination.

Personal data processed by AI systems is subject to the same safeguards, retention limits, and lawful bases described in this Notice. We do not sell personal data to AI training datasets or third-party AI providers, and personal data is never used to train external AI models.

You have the following privacy rights:

• Right to access your personal data. (Art. 18 (II), 19, LPGD).
• Right to correct incomplete, inaccurate, or out-of-date personal data. (Art. 18 (III), LGPD).
• Right to anonymization, blocking or deletion of unnecessary or excessive data or data processed in noncompliance with LGPD. (Art. 18 (IV), LGPD).
• Right to data portability. (Art. 18 (V), LGPD).
• Right to deletion your personal data processed with your consent. (Art. 18 (VI), LGPD). There are exceptions to this right outlined in Art. 16, LGPD.
• Right to be informed of which public and private entities with whom the controller has shared data. (Art. 18 (VII), LGPD).
• Right to be informed of the possibility of not providing consent and the consequences for such denial. (Art. 18 (VIII), LGPD).
• Right to revoke your consent to process your personal data. (Art. 18 (IX), LGPD).
• Right to lodge a complaint regarding our processing of your personal data with the national authority. (Art. 18 (§ 1), LPGD).
• Right to request a review of decisions based on processing of personal data carried out exclusively by automated means. (Art. 20, LGPD).
