Data Center Energy LLC  (“DCE”, “we”, “us”, or “our”) values your privacy and is committed to protecting personal data in accordance with applicable data protection laws, including the Brazilian General Data Protection Law (Lei Geral de Proteção de Dados Pessoais – “LGPD”).

This Privacy Notice explains how we collect, use, store, share, and protect personal data of individuals located in Brazil when they interact with our website, services, and business operations. It also describes your rights under the LGPD and how you may exercise them.

Data Protection Officer (DPO)

Data Center Energy LLC has appointed a role-based Data Protection Officer in accordance with Article 41 of the LGPD.

This Privacy Notice applies to individuals located in Brazil whose personal data is processed by Data Center Energy LLC, including:

Why do we process your personal data?

We process personal data for the following purposes and based on the corresponding legal grounds under the LGPD:

  • Responding to inquiries and communications
    Personal data is processed to respond to requests and inquiries submitted through our website.
    Legal basis: performance of contract or preliminary contractual procedures (Art. 7(V)) and legitimate interest (Art. 7(IX)).

  • Providing and offering services
    Personal data is processed to provide brokerage, marketplace, and related services.
    Legal basis: performance of contract (Art. 7(V)).

  • Marketing and newsletter communications
    Personal data is processed to send newsletters or informational communications when you opt in.
    Legal basis: consent (Art. 7(I)).

  • Lead generation and business development
    Personal data is processed to support business development and customer relationship management activities.
    Legal basis: legitimate interest (Art. 7(IX)), balanced against your fundamental rights and freedoms.

We collect and process only the personal data necessary to achieve the purposes described above, in accordance with the principles of necessity and data minimization.

Where processing is based on your consent, you may choose whether or not to provide consent and may withdraw it at any time without affecting the lawfulness of processing carried out prior to withdrawal.

Disclosure of your personal data

Personal data is disclosed only for internal business purposes and is accessible solely to authorized personnel.

Data Center Energy LLC processes personal data primarily in the United States. As a result, personal data collected from individuals in Brazil may be transferred to and processed outside Brazil. Such transfers are conducted in accordance with applicable data protection laws and appropriate safeguards.

We do not sell personal data.

  • Right to be informed. (Art. 18 (I), LGPD).
  • Right to access your personal data. (Art. 18 (II), 19, LPGD).
  • Right to correct incomplete, inaccurate, or out-of-date personal data. (Art. 18 (III), LGPD).
  • Right to anonymization, blocking or deletion of unnecessary or excessive data or data processed in noncompliance with LGPD. (Art. 18 (IV), LGPD).
  • Right to data portability. (Art. 18 (V), LGPD).
  • Right to deletion your personal data processed with your consent. (Art. 18 (VI), LGPD). There are exceptions to this right outlined in Art. 16, LGPD.
  • Right to be informed of which public and private entities with whom the controller has shared data. (Art. 18 (VII), LGPD).
  • Right to be informed of the possibility of not providing consent and the consequences for such denial. (Art. 18 (VIII), LGPD).
  • Right to revoke your consent to process your personal data. (Art. 18 (IX), LGPD).
  • Right to lodge a complaint regarding our processing of your personal data with the national authority. (Art. 18 (§ 1), LPGD).
  • Right to request a review of decisions based on processing of personal data carried out exclusively by automated means. (Art. 20, LGPD).
